New regulations have been introduced in Ireland to allow the spouses and dependants of Irish Critical Skills Permit (Green Card) holders easier access to employment in Ireland.

These new arrangements mean spouses and dependants (de-facto/ civil partners) of Ireland Green Card holders can apply for an employment permit to work in Ireland in any occupation. Under the new regulations, the employer does not need to undertake a labour market needs test for spouse/dependent work permits.

Permit Validity

Ireland Spousal Permits, or permits for dependents, are normally issued for the period up to the expiry date of the permit of the existing work permit holder, and can be renewed later.

Requirements

To be eligible for a work permit in Ireland, the spouse or dependant must be legally resident in Ireland on the basis of being a dependant of an Irish Critical Skills Employment Permit holder who must have one of the following:

The applicant's spouse must have a valid Ireland Green Card Permit;
The spouse/ dependent that is to apply for a Spouse/ Dependent Employment Permit must be legally in Ireland, on an entry/ tourist visa;
The spouse/ dependent of the Green Card holder must have a valid job offer from an Irish employer;

The Green Card holder must still be working within the terms of their employment permit.

To apply for a spouse work permit, you need a job offer from an employer registered and trading in Ireland.

Who can apply for this work visa?

Only spouses and dependant unmarried children under the age of 18 who have been admitted to Ireland as family members of a work permit holder can apply. The primary Irish work permit holder must have had their permit for at least 12 months before you can apply for a spouse/dependant permit.

What is the duration of stay granted by this particular Irish work permit?

A work permit under this scheme will normally be issued for the period up to the expiry date of the permit of the existing Irish employment permit holder.

If I’m granted a Spousal/Dependant Work Permit what do I do?

Once your receive your Ireland Spouse Work Permit, or your Ireland Dependant Work Permit, you will need to check with the National Garda Registration Office to ascertain if your current permission to remain in Ireland needs to be updated. This must be done in order to have the correct immigration status for permission to remain in Ireland.

If an Ireland Spouse/Dependant Work Permit, what does it entitle them to?

Any work permit granted to a spouse or dependant will be issued to the employee and will allow them to be employed in Ireland by the employer and in the occupation specified on the permit. Permits can be renewed after the initial period granted.

Can I change employers in Ireland?

If this is your first employment permit in Ireland then (other than in exceptional circumstances) you are expected to stay with your initial employer for a period of 12 months, after which you may move employers, provided that a new application for a spousal/dependant permit is made.

I am resident in Ireland as a spouse or dependant of an employment permit holder who has now received long-term residency – am I eligible to apply under this scheme?

I am over 18 and am in Ireland as a dependant of an Employment Permit Holder – I have now finished my studies, can I apply for an Ireland Work Visa?

Yes. This Dependant Work Permit is available, on an exceptional basis, to dependants who have reached the age of 18. These applications will be dealt with strictly on a case-by-case basis and can only be considered for dependants who arrived in Ireland while still minors and whose immigration status in Ireland is in order.

I am over 18 and have recently arrived in Ireland to join a family member of which I am a dependant and who is an Ireland Employment Permit Holder – can I apply for a work permit?

No. This particular scheme is only available to people who arrived in Ireland while still minors (i.e. under 18 years of age), and who have now completed their education and wish to take up full time employment.
